(1) Introduction
Welcome to FocalHub. These Terms & Conditions govern your use of the FocalHub platform.
By creating an account or using our services, you agree to these Terms in full.
(2) Interpretation
In these Terms, “we”, “us”, and “our” refer to FocalHub, a software-as-a-service platform.
“You” refers to any user of the platform, including Contributors and Customers.
(3) Platform Overview
FocalHub is a SaaS platform enabling Contributors to upload, license, and sell digital images,
and to offer photography-related services. FocalHub is not a photography agency, employer,
booking agent, or service provider. All services and content are provided solely by Contributors.
(4) Account Eligibility
You must be at least 18 years old to use FocalHub. You agree to provide accurate information
during registration and keep your details up to date. We may suspend or terminate accounts
that violate these Terms or pose a risk to the platform.
(5) Contributor Content Ownership & Licensing
Contributors retain full copyright ownership of all content they upload.
By uploading content, Contributors grant FocalHub a worldwide, non-exclusive, royalty-free,
perpetual licence to:
– host, store, display, and distribute the content;
– use the content for marketing, promotion, and platform demonstration;
– sell or sublicense the content as digital downloads, prints, or derivative products;
– create collections, bundles, or curated sets.
This licence survives account closure for any past uses or sales already made.
Contributors must only upload content they own or have full rights to license.
(6) Customer Licensing of Digital Content
When purchasing digital content, Customers receive a licence defined by the Contributor at checkout.
Contributors select from FocalHub’s predefined licence templates, including Personal, Commercial,
and Extended licences.
Customers may not redistribute, resell, or use content beyond the purchased licence scope.
FocalHub is not responsible for licence disputes but may mediate at its discretion.
(7) Prohibited Content
The following content is strictly prohibited on FocalHub:
– Adult or sexually explicit material;
– Graphic violence or gore;
– Hate speech or extremist imagery;
– Copyrighted material without permission;
– Sensitive personal data;
– Illegal content of any kind;
– Defamatory or malicious content;
– Content intended to harass, threaten, or harm.
We may remove prohibited content and take action against the account.
(8) Contributor Responsibilities
Contributors agree to:
– upload only content they own;
– provide accurate descriptions for services and digital products;
– deliver services professionally and on time;
– respond to disputes and customer messages;
– honour the licence purchased by the customer;
– avoid bypassing the platform for payment or communication;
– maintain professional conduct at all times.
(9) Customer Responsibilities
Customers agree to:
– use purchased content only within the licence terms;
– attend booked services or provide timely cancellation;
– communicate respectfully with Contributors;
– not attempt to bypass the platform;
– not misuse or redistribute content;
– provide accurate information when booking services.
(10) Service Bookings, Cancellations & Refunds
Cooling-off period: Customers may cancel within 24 hours of booking for a 100% refund.
Refund schedule after 24 hours:
– More than 30 days before: 75% refund;
– 14–30 days before: 50% refund;
– 7–14 days before: 25% refund;
– Within 7 days: 0% refund.
Rescheduling:
– One free reschedule if requested more than 7 days before the shoot;
– Rescheduling within 7 days is at the Contributor’s discretion.
Contributors may adopt their own cancellation policies if clearly stated in their listings.
(11) Disputes & Evidence Requirements
All disputes are assessed case-by-case based on evidence. Both parties must provide evidence,
which may include messages, timestamps, photos, GPS data, delivery logs, and service descriptions.
FocalHub logs all disputes against both parties to identify patterns of abuse or fraud.
Quality disputes must be resolved directly between the Customer and Contributor.
FocalHub may mediate but is not responsible for the outcome of the service.
(12) Payouts & Withholding
Contributors may choose their payout schedule. A minimum payout threshold of £20 applies.
FocalHub may temporarily withhold payouts if a dispute is open, a chargeback is pending,
fraud is suspected, or evidence is under review. Contributors will be notified via platform
message and/or email with the reason for the hold. Funds are released once the issue is resolved.
(13) Fees & Commissions
FocalHub charges a commission on digital sales and service bookings. Stripe processing fees apply.
Fees may change with notice.
(14) Messaging & Platform Conduct
Users may not share personal contact details, arrange off-platform payments, harass others,
spam, or attempt to bypass FocalHub’s systems. Violations may result in suspension or termination.
(15) Account Suspension & Termination
We may suspend or terminate accounts for repeated disputes, fraud, prohibited content,
harassment, bypassing the platform, copyright infringement, illegal activity,
or failure to comply with these Terms. Users may appeal decisions, but our final decision is binding.
(16) Limitation of Liability
FocalHub is not responsible for the quality of services provided by Contributors, missed shoots,
delays, customer dissatisfaction, damages, losses, or misuse of licensed content.
The platform is provided “as is” without warranties.
(17) Indemnity
Users agree to indemnify FocalHub against claims arising from uploaded content, service delivery,
licence misuse, copyright infringement, or breach of these Terms.
(18) Changes to Terms
We may update these Terms at any time. Continued use of the platform constitutes acceptance
of the updated Terms.
(19) Governing Law
These Terms are governed by the laws of England and Wales.
